1. Acceptance of Terms

By accessing and using the PlantAid website (plantaid.co) and all associated services, features, and content (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all the terms and conditions outlined herein, you must not access or use the Service. PlantAid reserves the right to modify these Terms at any time, and your continued use of the Service following such modifications constitutes your acceptance of the updated Terms.

2. Description of Service

PlantAid is a digital platform that provides plant care guidance, information, and recommendations. The Service includes access to a database of plant profiles, care instructions, watering schedules, pest and disease identification tools, and personalized care reminders. The Service is delivered through our website and may include additional features or modifications as we develop and improve the platform.

PlantAid operates on a subscription basis as described in Section 4 below. Access to certain features may require an active paid subscription. Free features, if available, may be subject to limitations and changes at PlantAid's discretion.

To use certain features of the Service, you may be required to create a user account. When creating an account, you agree to:

4. Payment Terms and Subscription

4.1 Subscription Pricing

PlantAid offers a subscription service at $5.00 USD per month (the "Subscription"). This price is subject to change with thirty (30) days' written notice. Price changes will not apply to active subscriptions until the next billing cycle. By entering a Subscription, you authorize PlantAid to charge your payment method on a recurring monthly basis.

4.2 Billing

Billing occurs automatically on the same date each month on which you initiated your subscription. You are responsible for providing valid and current payment method information. If a payment fails, PlantAid will attempt to process the charge again. Failure to maintain valid payment information may result in suspension of your account and access to the Service.

4.3 Cancellation Policy

You may cancel your Subscription at any time by accessing your account settings or by contacting PlantAid support. Cancellation takes effect at the end of your current billing period. No refunds will be issued for the current billing period in which cancellation is requested. You will retain access to premium features through the end of the current billing cycle, after which your account will revert to free tier access if available, or access will be terminated.

4.4 Refund Policy

PlantAid operates a strict no-refund policy for active Subscription periods. Charges are non-refundable once a billing cycle has commenced. In the event of a billing error or duplicate charge made in error by PlantAid, you may request a refund within thirty (30) days of the erroneous charge by contacting support with documentation of the error. PlantAid will investigate billing disputes and issue a refund or credit at its sole discretion if an error is confirmed. Requests for refunds outside this thirty-day window will not be considered.

4.5 Free Trial

PlantAid may periodically offer free trial periods. If you enroll in a free trial, your Subscription will automatically convert to a paid Subscription at the end of the trial period unless cancelled prior to the conversion date. You are responsible for cancelling before the trial period ends to avoid charges.

5. Intellectual Property Rights

All content, features, and functionality of the PlantAid Service, including but not limited to text, graphics, logos, images, audio clips, video clips, data compilations, and software code, are the exclusive property of PlantAid or its content suppliers and are protected by United States and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for your personal, non-commercial purposes only. You may not reproduce, distribute, transmit, display, perform, or otherwise use any content from the Service without PlantAid's prior written consent, except for personal use on a single device.

You agree not to modify, adapt, translate, reverse engineer, decompile, disassemble, or attempt to derive the source code of any portion of the Service. You may not rent, lease, or lend the Service. Any unauthorized use of the Service or its content is a violation of these Terms and may result in legal action.

6. User-Generated Content

If the Service permits you to submit, upload, or share content such as comments, photos, or notes (collectively, "User-Generated Content"), you retain ownership of such content. By submitting User-Generated Content, you grant PlantAid a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content for the purposes of operating and improving the Service. You represent and warrant that you own or have the necessary rights to the User-Generated Content you submit and that your submission does not violate any applicable laws or third-party rights.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall PlantAid, its officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses arising out of or relating to these Terms or your use of the Service, whether or not PlantAid has been advised of the possibility of such damages.

PlantAid's total liability to you under these Terms shall not exceed the total amount of fees paid by you in the twelve (12) months preceding the claim, or fifty dollars ($50.00), whichever is greater. Some jurisdictions do not allow the limitation or exclusion of liability for consequential or incidental damages, so the above limitation may not apply to you.

You acknowledge that the Service is provided on an "as-is" and "as-available" basis, and PlantAid disclaims all warranties, whether express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose. PlantAid does not warrant that the Service will be uninterrupted, error-free, or that defects will be corrected.

8. Disclaimer - Entertainment and Informational Purposes Only

IMPORTANT: The information, guidance, and recommendations provided by PlantAid, including but not limited to plant care instructions, watering recommendations, pest identification, disease treatment suggestions, and fertilization advice, are provided for entertainment and informational purposes only and do not constitute professional horticultural, botanical, agricultural, or veterinary advice.

PlantAid makes no representations, warranties, or guarantees regarding the accuracy, completeness, timeliness, or reliability of any content provided through the Service. The information on the Service is not intended to replace professional consultation with a qualified botanist, horticulturist, agricultural extension office, or other licensed professional.

Plant care outcomes depend on numerous factors outside PlantAid's control, including but not limited to climate conditions, soil composition, light exposure, humidity, pest and disease pressures, your specific implementation of recommendations, and variations in plant genetics. Results achieved by other users are not guaranteed to be replicated.

Neither PlantAid nor any of its content providers assumes any responsibility for consequences arising from the use of any recommendations, suggestions, or information provided through the Service. You use all information at your own risk and discretion. Before implementing any significant changes to your gardening or plant care practices, consulting with a qualified professional is strongly recommended.

PlantAid shall not be liable for any damage to plants, loss of plants, injury to persons, property damage, or economic loss resulting from reliance on information provided through the Service, even if PlantAid has been advised of the possibility of such harm. This disclaimer applies to all plant-related guidance, including but not limited to care instructions, pest control methods, disease treatment protocols, and nutritional recommendations.

Pest identification, disease diagnosis, and treatment recommendations are educated suggestions only and may not be accurate for your specific situation. PlantAid recommends consulting local agricultural extension services or professional plant health experts for definitive diagnosis and treatment of plant problems.

These Terms and your use of the Service are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. You agree that any legal action or proceeding relating to these Terms shall be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction and venue of such courts.

11. Changes to Terms and Service

PlantAid reserves the right to modify these Terms at any time. Modifications will be effective upon posting the revised Terms to the Service. Your continued use of the Service following the posting of revised Terms constitutes your acceptance of the changes. If you do not agree to the modified Terms, you must discontinue use of the Service.

PlantAid may also modify, suspend, or discontinue the Service or any portion thereof at any time, with or without notice. PlantAid shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

12. Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, the provision shall be severed.
